These Terms and Conditions govern your use of Nimbus house rental services and our website. By accessing our services or making a booking, you agree to be bound by these terms. Please read them carefully before proceeding.
1. Definitions
In these Terms and Conditions:
- "We," "Us," "Our," or "Nimbus" refers to the company operating house rental services
- "You" or "Guest" refers to the person making a booking or using our services
- "Property" refers to any residence available for rental through our services
- "Booking" means a confirmed reservation for a Property
- "Agreement" means the rental contract formed when a booking is confirmed
- "Services" refers to property rental and related services we provide
2. Acceptance of Terms
By using our services, you confirm that:
- You are at least 18 years of age
- You have the legal capacity to enter into binding agreements
- You accept these Terms and Conditions in full
- All information you provide is accurate and complete
If you do not agree to these terms, you must not use our services.
3. Service Description
Nimbus provides house rental services in Thailand, offering:
- Single Pavilion Residences for 2-4 occupants
- Multi-Pavilion Compounds for 6-12 occupants
- Estate Pavilion Complexes for 15+ occupants
Property availability is subject to confirmation. We reserve the right to modify service offerings, though existing confirmed bookings will be honored.
4. Booking Process
4.1 Inquiry and Confirmation
A booking is confirmed only when:
- You submit a booking request with complete information
- We verify property availability for your requested dates
- You receive written confirmation from us
- Required payment is received according to payment terms
4.2 Booking Requirements
When making a booking, you must provide:
- Full name and contact information
- Accurate number of occupants
- Preferred check-in and check-out dates
- Any special requirements or requests
- Valid payment method
5. Payment Terms
5.1 Pricing
All prices are quoted in Thai Baht (฿) and are subject to change. Confirmed bookings are honored at the agreed price.
5.2 Payment Schedule
- A deposit is required to secure your booking (amount specified at time of booking)
- Remaining balance is due according to the payment schedule provided
- Payment must be received by the specified deadline to maintain the reservation
5.3 Accepted Payment Methods
We accept bank transfers and other payment methods as specified during the booking process.
5.4 Security Deposit
A refundable security deposit may be required for certain properties. This deposit covers potential damages or excessive cleaning requirements. It will be refunded within 14 days after check-out, subject to property inspection.
6. Cancellation and Refund Policy
6.1 Cancellation by Guest
- Cancellations more than 60 days before check-in: 80% refund of total booking amount
- Cancellations 30-60 days before check-in: 50% refund of total booking amount
- Cancellations 14-29 days before check-in: 25% refund of total booking amount
- Cancellations less than 14 days before check-in: No refund
6.2 Cancellation by Nimbus
If we must cancel your booking due to unforeseen circumstances, you will receive a full refund or the option to rebook at an alternative property.
6.3 Force Majeure
Neither party is liable for cancellation due to events beyond reasonable control, including natural disasters, government restrictions, or other force majeure events. In such cases, we will work with you to find a fair resolution.
7. Guest Responsibilities
7.1 Property Use
You agree to:
- Use the Property in a respectful manner
- Comply with maximum occupancy limits
- Follow property rules and house guidelines provided
- Maintain cleanliness and reasonable order
- Report any damages or maintenance issues promptly
- Respect neighboring properties and local communities
7.2 Prohibited Activities
The following are strictly prohibited:
- Illegal activities of any kind
- Subletting or unauthorized third-party use
- Events or parties exceeding agreed occupancy
- Smoking in non-designated areas (if applicable)
- Damage to property or furnishings
- Excessive noise or disturbances
7.3 Liability for Damage
You are responsible for any damage caused to the Property during your stay, whether by yourself or your guests. Costs for repairs or replacement will be deducted from your security deposit or billed separately.
8. Our Responsibilities
Nimbus commits to:
- Provide properties that match descriptions and photographs
- Ensure properties are clean and maintained before your arrival
- Address maintenance issues promptly during your stay
- Provide support and assistance as outlined in your booking
- Respect your privacy while maintaining property access for essential services
9. Limitation of Liability
9.1 Service Provision
Properties and services are provided on an "as is" basis. While we strive for high standards, we do not guarantee:
- Uninterrupted availability of utilities or services
- Specific outcomes or experiences
- Absolute freedom from defects or issues
9.2 Excluded Liability
We are not liable for:
- Loss or damage to personal belongings
- Injuries occurring on the property (except where caused by our negligence)
- Disruptions due to events beyond our control
- Third-party service failures
9.3 Liability Cap
Our total liability for any claims arising from your booking is limited to the total amount paid for that booking.
10. Privacy and Data Protection
Your personal information is handled in accordance with our Privacy Policy. By using our services, you consent to data processing as described in that policy. Please review our Privacy Policy for details.
11. Dispute Resolution
11.1 Informal Resolution
If you have concerns or disputes, please contact us first. We commit to working towards fair resolution through good-faith discussion.
11.2 Governing Law
These Terms and Conditions are governed by Thai law. Any disputes will be subject to the jurisdiction of Thai courts.
11.3 Mediation
For disputes that cannot be resolved informally, both parties agree to attempt mediation before pursuing legal action.
12. Modifications to Terms
We may update these Terms and Conditions periodically. Changes will be posted on our website with an updated "Last Updated" date. Your continued use of our services after changes become effective constitutes acceptance of the modified terms.
Existing confirmed bookings remain subject to the terms in effect at the time of booking confirmation.
13. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
14. Entire Agreement
These Terms and Conditions, together with your booking confirmation and our Privacy Policy, constitute the entire agreement between you and Nimbus regarding your use of our services.
